Moreover, the emotional distress arising from personal observation of physical injury or other physical consequences of an accident to a third person requires a showing of a direct causal link between the physical consequences of the tortfeasors negligence and the emotional distress sustained by the plaintiff. (Alcorn v. Anbro Engineering, Inc., 2 Cal.3d 493, 498, 86 Cal.Rptr. 88, 90, 468 P.2d 216 (1970).) In Sheffet, the California Supreme Court’s most recent case on negligent infliction of emotional distress, the court held that “a passenger who was not physically injured in an automobile accident at the scene of that accident may recover damages for negligently inflicted emotional distress if the other requirements of Alcorn are met.” (Sheffet, at 1025, 13 Cal.Rptr.2d 829, 840, 36 P.3d 1119.)
However, it is not simply the observation of the emotional distress of another which will support a cause of action for negligent infliction of emotional distress. Rather, a plaintiff can establish a right to recover emotional distress damages for negligent infliction of emotional distress if the negligent tortfeasor’s conduct was “extreme and outrageous” or was “intended to inflict harm.” (Lancester v. Aetna Life Ins. Co., 43 Cal.App.4th 1055, 1061, 51 Cal.Rptr.2d 328 (1996).)
